Scope and Applicability

Winbd maintains strict Know Your Customer (KYC) and anti-money laundering (AML) controls as part of its regulatory compliance framework. This policy governs the collection, use, retention, and disclosure of personal data for identity verification and ongoing monitoring of customers enrolled to Winbd services. KYC verification is required before processing certain deposits, enabling withdrawals, or increasing transaction limits, and may be triggered by risk assessments or suspicious activity indicators.

Regulatory Framework and Risk-Based Verification

Winbd adopts a risk-based approach to customer due diligence. Depending on assessed risk, we apply Simplified Due Diligence (SDD), Customer Due Diligence (CDD), or Enhanced Due Diligence (EDD). SDD applies to low-risk profiles with limited activity, CDD to standard profiles, and EDD to high-risk customers, large or unusual transactions, or when additional information is warranted. Where risk assessment identifies concerns, Winbd reserves the right to restrict actions or request further verification before allowing activity to continue.

Identity Verification and Documentation

To satisfy KYC requirements, Winbd may request the following verification materials. Provision of information is mandatory for eligibility to participate and to complete verification:

  • Government-issued photo ID: The document must display the user’s full name, be valid, and not expiring imminently. The name on the ID must match the user’s registration details, and the user must be at least 18 years old.
  • Proof of residence: A recent document (e.g., bank statement or utility bill) showing the user’s name and current address, issued within the last three months. The name must correspond to the registration data and the document must be from a reliable source acceptable to Winbd.
  • Selfie with ID: A clear photograph of the user holding the same ID presented for verification, with the ID details visible and matching the registration data.

Additional or alternative documents may be requested at Winbd’s discretion to resolve any uncertainty regarding identity, address, or source of funds. Inability to provide required documentation may delay verification or result in temporary restrictions on account activity.

Ongoing Verification and Monitoring

Winbd conducts ongoing verification and monitoring of customer activity and transactions to detect fraud, financial crime, and compliance violations. This includes real-time screening, anomaly detection, periodic re-verification when warranted by risk assessments, and review of pattern changes that may indicate regulatory or legal concerns.

What Personal Data We Collect

Compelled by regulatory obligations and service delivery, Winbd collects personal data at registration and throughout the customer relationship. Collected information may include:

  • Identification details (name, date of birth, contact information)
  • Transaction history and payment details
  • Device and technical data (IP address, device identifiers, browser information)
  • Documents provided for verification and information obtained from reliable sources to support KYC

We use this data to verify identity, enable service access, process payments, provide customer support, assess risk, and comply with legal and regulatory requirements.

Data Sharing and Processors

Personal Data may be disclosed to:

  • Affiliates and service providers acting on Winbd’s behalf (e.g., payment processors, identity verification services, hosting, analytics, and communications).
  • Regulators, licensing authorities, and law enforcement agencies as required by law or to protect the integrity of the platform and users.
  • In the event of corporate transactions (merger, acquisition, or restructuring), Personal Data may be transferred as part of the transaction, subject to appropriate safeguards.

Winbd requires that third-party processors be bound by data protection obligations that are at least as protective as those set out in this policy.

Security of Personal Data

Winbd applies appropriate technical and organizational measures to protect Personal Data against unauthorized access, alteration, disclosure, or destruction. Access to Personal Data is limited to personnel with a legitimate need to perform KYC, AML/CFT, regulatory compliance, or customer-support duties. We deploy encryption, access controls, logging, incident response, and regular security assessments to safeguard information.

Data Retention

Personal Data collected for KYC and AML purposes is retained for as long as necessary to achieve the purposes for which it was collected, and in any event for no less than five years from the date of the last customer activity or account closure, to comply with regulatory obligations and for the defense of rights and obligations. Following retention, data will be securely deleted or anonymized where legally permissible.

You have rights regarding your Personal Data, subject to applicable law. These rights include:

  • Right of access to confirm what Personal Data Winbd holds and to obtain a copy;
  • Right to rectify inaccurate or incomplete data;
  • Right to erasure, subject to retention requirements and legal obligations;
  • Right to restrict processing under certain circumstances;
  • Right to data portability where applicable;
  • Right to object to processing for purposes including direct marketing and to withdraw consent where processing is based on consent;
  • Right to lodge a complaint with the relevant supervisory authority, where applicable.

Marketing Communications

You may opt out of marketing communications at any time by adjusting preferences in your account settings or by contacting Winbd support. Opting out does not affect essential account operations or service delivery.

Account Suspension, Restrictions, and Investigation

If there is a reasonable belief of non-compliance, fraudulent activity, or risk to users or Winbd, we may suspend or restrict access to all or part of the platform, freeze funds, or initiate an investigation. We may disclose findings to appropriate authorities in accordance with law and regulatory requirements. Actions taken will be proportionate to the risk and consistent with due process.
